Payment Terms
Payment for all SBB Tiki services and products must be made in United States Dollars (US$) by credit card. Services and products may not be provided or made available until payment has been received in full.
Sales Tax
SBB Tiki applies sales tax to applicable products and services in accordance with New Jersey state and local tax laws. The amount of sales tax charged will be based on the applicable tax rate at the time of purchase.
Reservation and Cancellation Terms
SBB Tiki, through our reservation platform (Peek), may charge your credit card at the time of booking.
Cancellations must be requested and acknowledged by SBB Tiki at least 48 hours before the scheduled boarding time to qualify for a full refund or rescheduling.
Cancellations made within 48 hours of the scheduled boarding time are non-refundable. No-shows are also non-refundable and cannot be rescheduled.
SBB Tiki reserves the right to cancel or postpone any tour when necessary due to weather conditions, safety concerns, mechanical issues, or other circumstances that may affect the safe operation of the vessel.
If SBB Tiki cancels a scheduled tour, guests will have the option to reschedule for another available date or receive a full refund.
SBB Tiki reserves the right to cancel, end, or terminate a tour at any time due to inappropriate guest behavior, excessive alcohol consumption, or conduct that compromises the safety or comfort of passengers, crew, or others.
In the event a tour is terminated for these reasons, no refund will be issued. Guests may also be held responsible for any damage to the vessel, equipment, or property resulting from their actions, to the extent permitted by applicable law.
Governing Law
In the event of any dispute or litigation arising from or relating to these terms, the parties agree that the laws of the State of New Jersey shall govern. The parties consent to the jurisdiction and venue of the applicable state or federal courts located in or serving Beach Haven, Ocean County, New Jersey, USA.
To the extent permitted by applicable law, both parties expressly waive any right to a trial by jury and agree to waive any right to remove or transfer an action to another jurisdiction or venue, including on the grounds of forum non conveniens.
These Terms and Conditions constitute the entire agreement between you and SBB Tiki regarding your use of our website, products, and services. They supersede all prior or contemporaneous communications, representations, agreements, and proposals, whether electronic, oral, or written, relating to the same subject matter.
No modification or amendment to these Terms and Conditions will be effective unless authorized by SBB Tiki.
If any provision of these Terms and Conditions is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted and modified to the extent necessary to reflect, as closely as possible, the original intent of the parties while remaining consistent with applicable law. The remaining provisions shall continue in full force and effect.
