Payment Terms
Payment for services or products is in United States Dollars (US$) by Credit Card. Services and products may not be provided until payment has been received in full.
Sales Tax
SBB Tiki charges sales tax for certain products and services based on the applicable sales tax laws of New Jersey.
Reservation and Cancellation Terms
SBB Tiki, through our reservation platform (FareHarbor), charges your credit card at the time of booking.
Cancellations must be made, and acknowledged by SBB Tiki, at least 48 hours prior to scheduled boarding, for a full refund or rescheduling. Cancellations within 48 hours of scheduled boarding will not be refunded. No shows will not be refunded or rescheduled.
SBB Tiki reserves the right to cancel any tour at any time due to weather, safety or mechanical reasons. In this case, SBB Tiki will offer to reschedule the tour or offer a full refund.
SBB Tiki reserves the right to cancel or end a tour at any time due to patron/guest behavioral or alcohol related issues. In this case, no refund will be issued and the patron is responsible for any applicable damages.
Governing Law
In the event of litigation, both parties agree that the Laws of New Jersey shall apply and both parties consent to the jurisdiction of the local courts of Beach Haven, Ocean County, New Jersey, USA. Both parties expressly waive a trial by jury and waive any right of removal or transfer, whether due to forum non-convenience or other reason.
These Terms and Conditions constitute the entire agreement between you and SBB Tiki with respect to our web sites, products and services. The Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and SBB Tiki with respect to our web sites, products and services. No change of the Terms and Conditions shall be effective unless it is authorized by SBB Tiki. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be construed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.
